No Due Process
by JD Nutt, IG Web-Editor
Web Sites and Domain Names Seized by Big Sis
Report last updated on November 27th, 2010 - Oklahoma City, OK.
With the zeal of the former Nazi regime, various US Government agencies with unchallenged authority, took down more than 75 websites without due process of law.
Armed with an ambiguous warrant, the Fed's took down sites that allegedly violated copy right laws.
Domains are being seized at will without due process courtesy of the censorship bill’ COICA that is not enacted yet as a law by congress.
Web surfers who visit the search engine Torrent-Finder.Com site are greeted with the graphic to the left which indicates that DHS and other Federal agencies have seized the web-site's domain name.
The Feds are now censoring the internet as they see fit as does communist China. However the difference is that the sites the Feds decide to censor will be completely removed from the internet, not just in the United States, as a result of domain name seizure.
The process to remove the seizure warrant and regain the domain name is to file a motion in the Federal court to argue against the seizure. The burden of proof and the presumption of Innocence seems to be a misnomer by the Feds on this seizure process.
However, there is an error with the action against Torrent-Finder. The site does not host or even link to any torrents whatsoever, it actually only returns searches through embedded iframes which display other sites that are not under the control of the Torrent-Finder owner. Other major search engines will return the same search results as Torrent-Finder does with perhaps a different format.
Consequently, this reveals the act of unwarranted government censorship. Will political talk show sites that speak out against the current government administration be next?
Comically, Torrent-Finder remains operational through another URL, Torrent-Finder.Info that the Fed's missed.
To bypass the Fed's rage of enforcement, one only has to set up an alternate domain name and web hosting provider in another country that is friendly to the term of "World Wide Web". Julian Assange , who continues to embarrass the Pentagon, has been a success at alternate domain names and servers in order to remain on the web.
Censorship in Nazi Germany was implemented by the Minister of Propaganda, Joseph Goebbels. All media, such as literature, music, newspapers, along with public events were censored. Attempts were also made to censor private communications, such as mail and even private conversation, with mixed results.

Comments:
In a world of online retailing, the ability for authorities to seize any business, whether thru blocking a domain or seizing the servers, constitutes a pre-conviction by the act of the seizure. If 75 brick and mortar business's were seized in the same manner, it would be fascism.
CBS News and CNET Technology Analyst Larry Magid said not everyone is in agreement with this action.
"This is a very controversial practice, which of course is supported by companies in the video and motion picture and music business, but opposed by some civil rights activists and organizations who feel that it's an improper use of government authority, because it's shutting down an entire domain in an attempt to get at some allegedly infringing material," Magid said.
Everyone charged with a penal offence has the right to be presumed innocent until proved guilty according to law in a public trial at which he has had all the guarantees necessary for his defense. UN.Org
